Wouldn't It Be Hilariously Funny . . .
My friends warn me against too much schadenfreude, but I think even they would admit that this scanario would be hysterical.
Imagine President Obama nominating someone to the Supreme Court with confidence that his appointee will be a flaming liberal. But then, the new justice begins racking up a solid conservative, strict constructionist voting record along with Justices Antonin Scalia, John Roberts, Clarence Thomas, Samuel Alito and (generally) Anthony Kennedy. That means instead of 5-4, we'd have 6-3.
There is precedent. Justice Souter ended up being a liberal as did the late Chief Justice Earl Warren. In fact, President Dwight D. Eisenhower called Warren the "worst mistake" of his presidency.
Just think if the liberal appointee began voting conservative. Just imagine it.
We could then say that he or she has "grown" on the bench.
